1. Acceptance of Terms

By downloading, installing, or using Merge ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

These Terms constitute a legally binding agreement between you and the Merge team ("we", "us", "our").

2. Eligibility

You must be at least 13 years old to use Merge. By using the App, you represent that you meet this requirement. Users under 18 must have parental or guardian consent.

3. Account

3.1 Sign-In

Merge uses Apple Sign-In exclusively. By signing in, you authorize us to create an account using your Apple-provided identity token. You are responsible for all activity under your account.

3.2 Account Security

You must not share your Apple ID or allow unauthorized access to your account. If you suspect unauthorized access, revoke app access via Apple ID settings and contact us immediately.

4. Credits and Subscriptions

4.1 Credit System

Merge uses a credit-based system for AI video generation. Credits are deducted when a generation job is successfully submitted to our AI provider. Credits are not refunded for successfully generated videos — only for failed generation tasks (where our AI provider returns an error).

4.2 Free Credits

New accounts receive 100 free credits upon signup. These credits are added to your "purchased" balance and never expire.

4.3 Subscription Credits

Monthly subscription plans provide credits that reset at each billing cycle. Unused subscription credits do not roll over — they expire at the end of each billing period. This is stated clearly at the time of purchase.

4.4 Purchased Credits (One-Time Packs)

Credits purchased via one-time packs are added to your permanent balance and never expire, even if you cancel your subscription or delete and re-create your account (note: account deletion permanently removes all balances).

4.5 Pricing

All prices are listed in USD and subject to applicable taxes. Prices may change with advance notice. Apple handles all billing and applies Apple's standard 15-30% commission.

4.6 Refunds

All purchases are final and non-refundable except as required by applicable law or Apple's refund policy. For subscription billing disputes, contact Apple Support. We do not issue refunds for unused subscription credits at the end of a billing period.

4.7 Credit Expiration on Account Deletion

When you delete your account, all credit balances (subscription and purchased) are permanently removed. Credits cannot be transferred between accounts.

5. Content

5.1 Your Content

You retain ownership of the photos and videos you use as inputs. By submitting content to generate a video, you grant us a limited, non-exclusive license to process that content through our AI pipeline for the purpose of generating your requested output.

By publishing a video to the public feed, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and promote that video within the App and related marketing materials.

You must not use Merge to generate or publish content that:

Videos generated by Merge are created by artificial intelligence. If you share AI-generated content outside the App, we strongly encourage you to disclose that it is AI-generated.

The App, its design, code, trademarks, and branding are owned by us and protected by intellectual property laws. You receive a limited, non-transferable license to use the App for personal, non-commercial purposes.

AI-generated videos produced using the App are owned by you, subject to the input licenses granted to the AI provider per their terms. We make no claim of ownership over your generated videos.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

11. Termination

We may suspend or terminate your account at any time, with or without notice, if you violate these Terms or applicable law. You may delete your account at any time via Settings → Delete Account. Upon deletion, all your data is permanently removed.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by updating the "Last Updated" date. Continued use after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of your country of residence, without regard to conflict of law principles. Any disputes shall be resolved in the courts of your country of residence, unless otherwise required by applicable consumer protection laws in your region.
